This is the true story of the killing of a former State Supreme Court Judge by a bodyguard for a U.S. Supreme Court Justice. Justice Field and his bodyguard, Deputy Marshal Neagle, were charged with the murder of Judge Terry. Sarah Hill, the catalyst to the events leading to the shooting of Terry, relates the story. Orphaned at age 4 and educated in convent schools, in 1870 Sarah, then age 20, took charge of her inheritance and moved to San Francisco where she met U.S. Senator William Sharon of Nevada, a wealthy widower. In 1880 they signed a marriage contract declaring themselves married, but a secrecy clause required that the marriage remain secret for two years. Secrecy was needed because Sharon had fathered a child with another woman who would ruin his Senate re-election bid if she learned he married. By 1883 the marriage fell apart and Sarah filed for divorce; meanwhile, Sharon sued in federal court to have the contract declared a forgery. Sarah's attorney, David Terry, was originally from Texas and known for his honesty, chivalry and violent temper. Terry and Field had been together on the California Supreme Court Judge for two years, during which that they developed a deep animosity toward each other, Field despised Terry's Southern background and support of slavery and Terry despised Field's blatant corruption and use of the court for political and personal gain.After a trial laced with trickery and perjury, the marriage contract was ruled genuine and Sarah was granted a divorce and ordered an accounting of Sharon's assets so Sarah's community property award could be calculated . On appeal, the State Supreme Court said that the contract was genuine, but denied the divorce because the marriage was not valid: that a valid marriage had to be "open and notorious," a factor negated by the secrecy clause. Sharon died in 1885 and Sarah married Judge Terry a few months later. The federal court said the contract was forged, based primarily on Sarah's character: that Sarah had secretly been living with a man (Sharon) who was not her husband. Sarah appealed to the Circuit Court where Justice Field affirmed that the contract was forged, characterizing Sarah a "forger and voyeur." Sarah, offended by Field's attack on her honor, interrupted the reading of the decision to accuse Field of bribery. An altercation broke out ending in Sarah and Terry being jailed for contempt. During his 6-month sentence, Judge Terry issued threats against Justice Field, warning him not to return to California. U.S. Attorney General Miller ordered Marshal Franks in San Francisco to appoint a bodyguard for Field's next trip to California. Marshal Franks assigned Deputy Marshal Neagle to the task.Following their release in 1889, Sarah and Terry unexpectedly encountered Field and Neagle in a crowded railroad restaurant near Fresno. Sarah returned to her railroad car to get her pistol while Terry approached Field. Before Sarah returned, Neagle shot and killed Terry. Field and Neagle were arrested for murder, but the State later dropped charges against Field. Neagle was tried for murder without a jury by a federal judge pursuant to the federal habeas corpus statute that provided federal jurisdiction for acts occurring pursuant to a "law of the United States." With Field coaching behind the scene, Neagle was found not guilty despite evidence indicating murder; the judge instead commended Neagle for his heroic act. The State appealed to the U.S. Supreme Court asserting that the Executive Order appointing a bodyguard for Field was not a "law of the United States" required for federal jurisdiction under the habeas corpus statute, therefore Neagle should be tried in a state court. The Supreme Court did not agree.
