This report contains a detailed account of the findings of a delegation sent by the LAWASIA Human Rights Standing Committee to Sri Lanka to enquire into the circumstances of the outbreak of communal violence in that country during the last week of July 1983. It is based upon official and non-governmental documentation, and interviews with government officials, opposition parties and groups, and individuals. The report consists of six sections. The first contains a detailed factual account of the events and incidents that both led to and occurred during the last week of July 1983. The second section examines the treatment of displaced persons and their situation, especially with regard to camps, transportation facilities and rehabilitation. The third section contains an analysis of the Sri Lankan constitution in an attempt to evaluate whether the proclamation of the state of emergency during the period studied was justifiable. The fourth section deals extensively with the actions of all actors involved immediately before and during the state of emergency and assesses these actions in terms of the ten basic principles of human rights adopted by the LAWASIA Human Rights Standing Committee. These actors include governmental authorities at political, administrative and military levels, as well as non-governmental groups such as the Tigers, various political parties, religious groups, citizen's groups, and the mass media. The fifth section briefly examines the breaches of human rights resulting from the adoption of the Prevention of Terrorism Act, which is in conflict with several of the articles contained in the International Covenant on Civil and Political Rights. The last section contains the conclusions of the fact-finding mission and suggests possible courses of action. These include the desirability of calling an allparty conference to negotiate and find solutions to the current problems; the need for full enquiries to be held into what has happened; and the provisions for care and rehabilitation of displaced persons.
